REFUND & RETURNS POLICY

1. General Information
This Refund & Returns Policy applies to purchases made through the Birland Diamonds website (the “Website”).
The Website is operated and technically administered by AJDrive OÜ (Estonia) as a platform operator and authorised payment collection agent.
All products sold on the Website are sold by:

DELTA CAPITAL MANAGEMENT LIMITED is the Seller of Record, supplier, shipper, and the sole contractual counterparty of the customer.
2. Role of AJDrive OÜ
AJDrive OÜ:

is not the seller of the products;
-
does not manufacture, own, store, or ship the diamonds;

does not make decisions regarding refunds or returns;
-
may assist technically with payment processing on behalf of the Seller.
All refund and return decisions are made exclusively by the Seller.
3. Eligibility for Returns
Due to the high-value and customised nature of laboratory-grown cut diamonds, returns are accepted only under specific conditions.
A return may be accepted if:

the product materially differs from its IGI/GIA certificate;
-
the product is damaged upon delivery;
-
an incorrect product was delivered;
-
the product does not match the confirmed order specifications.
Returns are not accepted in cases of:

buyer’s change of mind;
-
normal wear or damage after delivery;
-
subjective dissatisfaction not related to certification or specifications;

improper handling after receipt.
4. Return Request Procedure
4.1. To request a return, the customer must contact the Seller at:

4.2. The return request must be submitted within:
5 (five) calendar days from the date of receipt of the product.
4.3. The request must include:

order number;
-
description of the issue;
-
clear photographs or video evidence.
5. Inspection and Approval
5.1. All returned products are subject to inspection by the Seller or an authorised gemological partner.
5.2. The Seller reserves the right to:

approve the return;
-
request additional documentation;
-
reject the return if conditions are not met.
5.3. The Seller’s decision is final.
6. Refunds
6.1. If a return is approved, the refund will be issued to the original payment method.
6.2. Refunds are processed within:
7–14 business days
after approval of the return.
6.3. Payment processing times may vary depending on the payment service provider.
6.4. AJDrive OÜ may technically process the refund on behalf of the Seller but does not decide on refund eligibility.
7. Return Shipping
7.1. If the return is approved due to Seller fault (incorrect or damaged product), the Seller will cover return shipping costs.
7.2. If a return is accepted at the Seller’s discretion, shipping costs may be borne by the customer.
7.3. Returned products must be:

securely packaged;

insured for full value;

shipped using a trackable courier approved by the Seller.
8. Chargebacks
8.1. Customers are encouraged to contact the Seller before initiating a chargeback.
8.2. Unauthorised or abusive chargebacks may result in account restrictions and dispute handling through payment providers.
9. Legal Compliance
This Refund & Returns Policy complies with applicable consumer protection laws.
Nothing in this Policy limits statutory consumer rights that cannot be waived under applicable law.
10. Governing Law
This Refund & Returns Policy shall be governed by the laws of the Republic of Estonia.
Any disputes related to the use of the Website or this Policy shall be subject to the jurisdiction of the courts of Estonia.
